Why this exists

The audit letter is not the analysis

A 1099 does not stop the carrier from treating unpaid-coverage subs as your payroll. A homemade waiver does not stop that. An officer exemption, where a state even allows one, is not a COI, and a lot of GCs will not take a sub’s exemption anyway.

We read the letter against the payees and the certs using the rules for the state on the policy. Florida shops get Florida officer-exemption and Fla. Stat. § 440.10. Other states get that state’s evidence-of-coverage rules. We do not call the carrier, and we do not promise they cut the bill. One contractor wrote that he paid $1,990, 16 percent of what he had paid a sub who dropped coverage and lied about it.
